An individual's immorality is a personal crime. A court's immorality is a crime of the people. I don't condone such gross immoralities; I don't want that stain on my hands.

If a child rapist knows he'll get the death penalty whether he leaves the child alive or kills him/her, then the rapist will just kill the child and get
rid of a crucial witness. Thus, you lose the deterrent affect of the death penalty when you use it on any crime that is short of murder.

Reasonable people can differ on whether the death penalty should be applied in certain cases, or at all. That's why people argue about it and legislatures try to decide what their citizens want the law to be. The Supreme Court's job is to step in when legislatures cross the line and implement 'cruel and unusual' punishments. I'm generally against the death penalty, but the majority opinion in this case is laughable. If I were a high school teacher and a student handed in a paper with this sort of reasoning, I'd give him a C-. I usually find myself defending the courts, but there is no question in my mind, after reading this opinion, that the 5 justices signing the majority opinion were acting as a super-legislature, not a court. Whatever your belief regarding capital punishment, we deserve better than this from our judges. |

The cost of execution is higher than keeping them alive in prison; however, if you put the whole thing on pay-per-view with big sponsors, we can turn a profit on this.
