i don't think you can do a damn thing. the wc companies will investigate if they think it's fraud. i knew a guy that did that for his knee and the
company had pictures of him working on a friends roof, he ended up having to get an attorney. i don't know the severity of the claim, but if it prevents
this person from working for a long time, it is likely they will take a close look at it.

I used to work for comp attorneys who represented injured workers. Most of our clients were correction officers, highway patrolmen and the like and their
injuries were legit. Then we had a woman who worked in an office job at the garbage company. Said she hurt her back at work and couldn't walk without pain.
I'll never forget when the insurance company brought in a movie projector just before a settlement conference at our office. There was our client, with cane and neck brace. We all gathered in the conference room to watch. On the movie, she was in her backyard, bending over with a shovel, hurling dirt over her shoulder. The film started with the investigator showing the front page of the SF Chronicle, Saturday, two days earlier. |

I got some AWESOME footage one time from a female PI who got this guy with a supposedly debilitating back injury, no work capacity, out drinking and dancing
and actually hitting on her. Hilarious. I kept a copy of that one for myself somewhere.

Most frustrating case I ever had was for Tinnitus secondary to a loud noise through a headset. Psych claim. Had to settle that shit for six figures, but we did
get some back from a third party action. But there's no definitive test for the fucking thing. 'I hear ringing. It's driving me crazy'. It was
absurd. I couldn't get a Doc to tell me definitively tell me it was bullshit OR legit, I couldn't get a Doc to tell me it couldn't have been caused
by the work incident, and I couldn't get shit on surveillance. But when it comes right down to it, the whole fucking 'injury' could have been
completely fabricated.
That and RSD/CRPS cases. Those suck. |
