In the previews for next week there is a quick scene that seems to be from the point of view from under a bed that shows somebody walking into a room. Seems quite similar to Sawyers flashback. Could it be that Sawyer IS on of the six? I didn't think so up until I noticed this little bit in the preview. Could he and Kate have Aaron or maybe he has his daughter and that is who is hiding under the bed....a reversal on the scene from his past and the child is simply hiding for fun and we see Sawyer pull him/her out from under the bed. Sawyer as a dad in flash forwards would be a surprise in my book. I will admit that I am jumping to conclusions based on such a small fragment of a clip in a preview though.

But that one is definitely the most random, and I think it's the only one not from season 4.

It's not from the scene where Sawyers dad comes in the room and shoots himself. Sawyers dad wore cowboy boots. Did they use that same shot somewhere else that I can't remember?

Any decent defense attorney would point out to a jury how irrelevant the plane crash is when it comes to the matter of her crimes. Here's another possibility to consider, though...I am not totally familiar with the way the criminal system works, but is it possible that Kate's Mom could refuse to press charges for murder, leaving insurance fraud as Kate's only crime--which, I believe, is a misdemeanor and would only result in a light sentence. That seems more likely to me than the whole legally declared dead thing.

Also, the People (Prosecutors) press charges in murder cases, not victims. There is no chance of anyone getting off on murder cos some person wouldn't press charges. Manslaughter maybe (I doubt it though), but not murder. My current opinion is that given Kate's ordeal, a judge sentenced her to time served.

There's no way to get back to the island and retrieve bodies or anything else. Depending on the future plot line it might be in everyone's self interest to not mention anything that happened on the island. Indeed there will need to be a cover story about where the Oceanic 6 actually were. My guess is they'll say they were found on a raft or other tiny island. How the heck are you going to explain in a court of law that a giant humongous island can't be found? Or that the airplane crash site was faked? And there are so many dark forces out there maybe it wouldn't be wise to mention anything island related either or risk your own death. Dharma, Widmore, Paik, ??? might even have threatened the survivors upon their return to the real world to not say anything. Maybe that's why Jack was worried about Hugo in the nut house. Speculating about law breaking and court proceedings are pretty worthless at this point. As far as Kate and Sawyer being responsible for crimes prior to being on the island that's totally possible. But wouldn't you think that whoever allows them to return to the real world might attempt to hide their real identities if possible, or replace them with body doubles if possible? My feeling is that Kate might be holding a low profile because she's not one of the Oceanic 6 from the public's perspective, that she might have been returned to the real world with a fake identity. The same could apply to Sawyer if he ends up being one of the O6. Or perhaps only 6 people are recognized publicly as survivors when in fact more people might be "saved" and given fake identities. You're right, Sawyer's dad did have different boots...I just assumed it was the same scene. But there were some reused scenes from episode 1 and 2.

Hell, the chopper pilot was able to see that it wasn't the pilot even though he wasn't recognizable. I think there is another explanation for Kate. Was she charged for murder or just an important witness?

I see 5 of the 6 as being: Jack & Kate-based on last season finally Hurley-based on first episode of this season Claire & Aaron-based on vision Desmond had in last season

I can see the producers showing Desmond telling Charlie about his vision of Claire on a helicopter in a "previously on Lost" reminder before the episode airs and the final scene of the episode is of Claire getting on the plane, it takes off (as in Desmond's vision), but suddenly it has to land for some random reason but Desmond missed THAT part in his vision. Scene switches to an obvious flash forward reveal and BAM: it's Locke who was the last member of the Oceanic 6! All Lost viewers watching that simultaneously piss, shit, and cum on themselves in disbelief and shock.
